you signify that you have read, understand and agree to be bound
by these Terms of Use.

Terms of Sale
All sales made through this website are final. No refunds will be
given for fees to Play or for Dinner, Sponsorships, or Donations.
Players and other participants will receive all related merchandise,
including shirts for players, at the tournament.
Proprietary Rights in Site Content; Limited License
All content on the Site, including designs, text, graphics, pictures,
video, information, applications, software, music, sound and other
files, and their selection and arrangement (the "Site Content"),
are the proprietary property of Savannah's Organic Ranch (SOR),
its users or its licensors with all rights reserved. No Site Content
may be modified, copied, distributed, framed, reproduced, republished,
downloaded, displayed, posted, transmitted, or sold in any form
or by any means, in whole or in part, without SOR's prior written
permission, except that the foregoing does not apply to your own
User Content (as defined below) that you legally post on the Site.
You are granted a limited license to access and use the Site and
the Site Content and to download or print a copy of any portion of
the Site Content to which you have properly gained access, provided
that you keep all copyright or other proprietary notices intact.
Any use of the Site or the Site Content other than as specifically
authorized herein, without the prior written permission of SOR,
is strictly prohibited and will terminate the license granted herein.
Such unauthorized use may also violate applicable laws including
copyright and trademark laws and applicable communications regulations
and statutes.
Disclaimers
SOR is not responsible or liable in any manner for any User Content.
Although we provide rules for user conduct and postings, we do
not control and are not responsible for what users post, transmit
or share on the Site and are not responsible for any offensive,
inappropriate, obscene, unlawful or otherwise objectionable content
you may encounter on the Site or in connection with any User Content
or Third Party Applications, Software or Content. SOR is not responsible
for the conduct, whether online or offline, of any user of the
Site or Membership.
The Site and the Membership may be temporarily unavailable from time
to time for maintenance or other reasons. SOR assumes no responsibility
for any error, omission, interruption, deletion, defect, delay in
operation or transmission, communications line failure, theft or
destruction or unauthorized access to, or alteration of, User communications.
SOR is not responsible for any technical malfunction or other problems
of any telephone network or Membership, computer systems, servers
or providers, computer or mobile phone equipment, software, failure
of email or players on account of technical problems or traffic congestion
on the Internet or at any Site or combination thereof, including
injury or damage to User's or to any other person's computer, mobile
phone, or other hardware or software, related to or resulting from
using or downloading materials in connection with the Web and/or
in connection with the Membership, including any Mobile Client software.
Under no circumstances will SOR be responsible for any loss or damage,
including any loss or damage to any User Content or personal injury
or death, resulting from anyone's use of the Site or the Membership,
any User Content or Third Party Applications, Software or Content
posted on or through the Site or the Membership or transmitted to
Users, or any interactions between users of the Site, whether online
or offline.
SOR reserves the right to change these Terms of Use at any time,
effective immediately upon posting on the Site. Please check this
page of the Site periodically. If you violate these Terms of Use,
SOR may terminate your use of the Site, bar you from future use
of the Site, cancel your Membership, and/or take appropriate legal
action against you.
Disclaimer of Warranties
YOU HEREBY WAIVE ALL OTHER REMEDIES, WARRANTIES, GUARANTEES OR LIABILITIES,
EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, WHETHER OR NOT
OCCASIONED BY THE NEGLIGENCE OF SOR. YOU ACKNOWLEDGE BY YOUR USE
OF SOR PRODUCTS THAT YOUR USE OF THE PRODUCTS AND ANY RELIANCE
UPON THEM IS AT YOUR SOLE RISK, AND THAT YOU ASSUME FULL RESPONSIBILITY
FOR ALL COSTS ASSOCIATED WITH ALL NECESSARY SERVICING OR REPAIRS
OF ANY EQUIPMENT YOU USE IN CONNECTION WITH SOR PRODUCTS. SOR
EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS
OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES
OF MERCHANTABILITY, QUALITY, PERFORMANCE, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS
ON IMPLIED WARRANTIES SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
THE WARRANTIES SET FORTH HEREIN GIVE YOU SPECIFIC LEGAL RIGHTS
AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. IF
AN ITEM HAS BEEN PURCHASED FOR CONSUMER USE AS DEFINED BY 15 U.S.C. § 2301,
ANY IMPLIED WARRANTY OR WARRANTIES SHALL EXPIRE ON EXPIRATION OF
ANY EXPRESS WARRANTY.
Waiver and Limitation of Liability
SOR HAS PRICED ITS PRODUCTS UPON THE UNDERSTANDING, AND YOU HEREBY
ACKNOWLEDGE THE UNDERSTANDING, THAT SOR WILL NOT BE RESPONSIBLE
OR LIABLE FOR ANY FORM OF CONSEQUENTIAL, INCIDENTAL, STATUTORY,
PUNITIVE, EXEMPLARY OR INDIRECT DAMAGES OF WHATEVER KIND OR TYPE
ARISING FROM ANY TYPE OF COMMERCIAL, BUSINESS, ENVIRONMENTAL, TORT,
WARRANTY, CONTRACT, STRICT LIABILITY OR OTHER CAUSES ARISING DIRECTLY
OR INDIRECTLY FROM OR IN CONNECTION WITH ANY PRODUCT AND/OR ITS
USE, EXCEPT CONSEQUENTIAL DAMAGES FOR ANY INJURY TO A PERSON IN
THE CASE OF PRODUCTS PURCHASED FOR CONSUMER USE AS DEFINED BY 15
US C. § 2301. YOU AGREE NOT TO JOIN IN ANY LAWSUIT WITH ANOTHER
PERSON OR SERVE AS A CLASS REPRESENTATIVE OF ANY CLASS ACTION LAWSUIT
AGAINST SOR ARISING OUT OF YOUR PURCHASE OR USE OF PRODUCTS ORDERED
VIA THE SITE.
Indemnification
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS SOR
FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES,
INCLUDING ATTORNEYS' FEES, ARISING FROM OR RELATED TO YOUR USE
OF ANY ITEMS PURCHASED VIA THE SITE.
Governing Law and Venue
This Agreement, the entire relationship between you and SOR, and
any litigation or other legal proceeding between you and SOR (whether
grounded in tort, contract, law or equity) shall be governed by
and construed in accordance with the laws of the State of California,
without giving effect to its choice of law rules. This contract
is fully performable in Orange County, California
Privacy Statement
This privacy statement, effective February 10, 2010,
applies to this Site and other Sites on servers owned by Savannah's
Organic Ranch (SOR).
At SOR, we share your concerns about privacy. We have
created this privacy statement in order to demonstrate our firm commitment
to privacy. The following discloses our information gathering and
dissemination practices for the site.
IP Address
We log all connections to our web servers. Those log files include
your IP address. An IP address is NOT personally identifiable information,
but general information about your location, connection to the
Internet, and your Internet Service Provider. We use your IP address
to help diagnose problems with our server and to administer the
Sites.
Cookies
"Cookies" are small pieces of information stored in a user's browser
that give that user a unique identification. If you are accessing our
protected content, we will use cookies for authentication purposes only. All
cookies are established on a per session basis, and are not permanently stored
on your machine.
Contact Form
The Site's ontact forms may request that users provide contact information
(such as their name, mailing address, telephone number and e-mail
address). We use this contact information to send the user additional
information. A user's contact information may also be used by us
to contact the user directly. We do not disclose, sell or rent
your contact information to third parties except when required
to disclose such information by law or in response to a request
from a law enforcement agency or authority.
In compliance with the Children's Online Privacy Protection
Act, 15 U.S.C. §§ 6501-06 and 16 C.F.R.,
§§ 312.1-312.12, our Sites do not permit children under
13 years of age to become users, and we do not collect personally
identifiable information from children. By using our Sites,
you represent that you are not under 13 years of age.
Except with regard to any contact information you may
provide us via the Site, all comments, feedback, information or materials
submitted to SOR through or in association with this website (collectively, "Feedback")
will be considered non-confidential and the property of SOR. By
submitting such Feedback to SOR, you agree that you assign to SOR,
without charge, all worldwide rights, title and interest, including
copyrights and other intellectual property rights, in and to the
Feedback. SOR shall be free to use such Feedback on an unrestricted
basis.
Security
The Sites have security measures in place to protect against
the loss, misuse and alteration of the information under our control;
however, SOR does not guarantee the performance or adequacy of such
security measures.
Links to other web Sites
The Site may contain links to other web sites that are not owned
or operated by SOR. SOR is not responsible for the privacy policies
or practices of third parties or the content or security of such
web sites.
